Most litigation involves business disputes. People had certain expectations entering into a relationship which were not met. Often the expectations were not documented or no contract was signed. Even more often, a contract did not or could not take into account all of the factors effecting each parties performance under the contract. Since we are talking about businesses, these disputes are almost always about one thing---MONEY. How can we get money that is owed to us or how can we avoid paying someone money that they claim is owed to them. Unfortunately, in many cases, the only answer is LITIGATION. People hate it. It is expensive. It is time consuming. But unless you are willing to walk away from the situation either without seeking payment or by making payment of a disputed item, you may not have a choice. The most important factor in this process is proper documentation. Once we get into litigation, we will take an aggressive posture for our clients if that serves their desires. Depending on the situation, our client may goals other than a quick resolution of the claim. We need to assess those goals, and make sure that they are within the confines of acceptable legal practice. If they are, we will take the action requested by our client.
